By this time in the magazine's history, Goldman and those close to her were mired in legal trouble due to her lecturing and printing information on birth control, and her anti-conscription stance. The offices of Berkman's magazine, The Blast, were raided, and arrests for Goldman, Berkman, and Ben Reitman loomed. Nevertheless, eight issues of Mother Earth were published in 1917, with contributions by Goldman, Berkman, Reitman, Harrison George, W.S. Van Valkenburgh, Peter Kropotkin, Walker C. Smith, Harry Weinberger, Ben Hecht, Ram Chandra, Maxwell Bodenheim, Margaret Anderson, and others. This run contains the rare penultimate number, devoted entirely to Goldman's and her partner Alexander Berkman's trial and conviction under the Espionage Act, for opposing America's entry into the First World War and for encouraging young men not to register for the draft. Goldman and Berkman famously represented themselves in the trial, which they used as a bully pulpit for criticizing America's war aims and the Espionage Act itself, which they (correctly, according to most constitutional scholars) characterized as an unconstitutional abridgment of the right to free speech. Berkman's closing address to the jury lasted something over two hours, and Goldman's more than an hour; both speeches are transcribed here with some ommissions, but including Goldman's oft-quoted passage: "I say, gentlemen, that we are greater patriots than those who shoot off firecrackers and say that democracy should be given to the world. By all means let us give democracy to the world. But for the present we are very poor in democracy..." Goldman and Berkman were convicted, imprisoned, and finally deported to Russia in 1919. In addition to lengthy transcriptions of the defendants' closing statements, this issue includes substantial direct commentary on the trial and on the conscription law by Goldman; further contributions by Charles Erskine Scott Wood, Randolph Bourne, and others.
